Terms and Conditions Cheque Information Entry Service

  • Under the usage of this service and within our wish to confirm issuance of the cheques drawn on our account at your Bank as set out in this application “Account”, we will enter the cheques information in the “Cheque Data Entry via CBK Online or CBK Mobile” system applied at the Bank. The entered cheques information should be matching the basic information stated in the cheques submitted to you by beneficiaries for encashment whether through Al-Tijari Online Service, CBK Mobile app .The cheque will be encashed directly to the beneficiary after verifying the integrity of the submitted cheque information without the beneficiary having to deliver the original cheque as per the applicable banking instructions.
  • In case any of the cheque information entered under this service differs from the information stated in the cheque submitted to you for encashment, or the cheque information is not fully or partially entered, you are kindly requested to direct the beneficiary to resubmit the cheque to the Bank later. You may withhold/ block the cheque amount on the Bank’s systems and charge the necessary commissions then notify us by any electronic means available at the Bank, so that we can respond to you with approval and confirmation of our issuance of the cheque. In this regard, we acknowledge the impact of such withholding/ blocking on the net balance of our account.
  • In compliance with local laws that consider cheques as a payment instrument, the Bank shall have the right to encash all cheques drawn on the said account if the cheque elements and mandatory information are complete, whether submitted through this service "Al-Tijari Online and CBK Mobile App." regardless the cheques information is entered by us, or the information we entered was incomplete or different from the information stated in the cheques presented to you for encashment. Furthermore, The Bank shall not bear any liability towards us, the beneficiary or third parties.
  • We acknowledge our full understanding that enrollment in this service is for protecting the cheques we issue and for facilitating their encashment process through CBK various channels.
  • I, the undersigned, acknowledge, comply and agree that I have read all the terms & conditions of the Cheque Entry Service, understood their contents and conclusively accepted the terms, conditions and obligations contained therein. Further, I declare that I have no right to object to such terms & conditions in future. The Bank may hold the cheque amount, charge commissions or take any other action whatsoever in the future in relation to this Service.
  • In the event the cheque is entered through Al-Tijari Online or CBK Mobile App., the relevant terms and conditions shall apply.
  • Any instructions previously issued by us in relation to the same Service previously described as "Online Cheque Authentication Service" shall be invalid & void upon signing this declaration form.
  • This service is provided to CBK customers only.
  • The drawer and beneficiary may not use the original cheque after encashing it from CBK in accordance with the abovementioned procedures, whether the cheques was encashed through the Al-Tijari Online Service, CBK Mobile App. as long as the beneficiary acknowledges that the cheque is considered canceled once it has been encashed and the beneficiary acknowledges not to use it after that.
  • Cheques submitted through this service may not be endorsed, given the fact that the beneficiary keeps the original cheque after encashment.
  • I acknowledge, comply and agree in my capacity as the issuer of cheques that: the Commercial Bank of Kuwait “CBK” will credit the cheques amounts in the accounts of the beneficiaries as soon as the cheques are processed through the Al-Tijari Online, CBK Mobile Application, after being verified, accepted even through images and not originals - and agreed by us through Al-Tijari Online service or CBK Mobile., for crediting the cheques amounts in beneficiaries accounts. I further declare bearing all liabilities in the event of any breach against CBK and third parties without any liability on the part of CBK.
  • The customer shall incur the liability for the integrity of the information provide in the cheque and for any misuse of this service. The customer shall not recourse against the Bank for any compensation for harms that arise due to misuse or fraud and electronic phishing.
  • All legal provisions for cheques encashment shall be committed.
  • The customer shall bear the full liability for losing his/her mobile phone, user name or password for Al-Tijari Online or Al-Tijari Mobile app. or for disclosing any such information. The customer shall further bear the liability for any attack that may target his phone or account and cause him/ her personal harm. The customer shall immediately notify the Bank of any loss or disclosure of such data and information, and bear the liability in the event of any breach thereof.
